TERMS OF SALE

Please carefully review the following Terms and Conditions of Sale (“Terms of Sale”) that govern the use of services provided by Jakuna Travel LLC (hereinafter referred to as "Jakuna," "we," "us," or "our"). These Terms of Sale constitute a binding legal agreement between you and Jakuna. By accessing or using our services, you acknowledge and agree to be bound by these Terms of Sale, as well as by our Privacy Policy and Website Terms of Use (“Documents Related”). If you do not agree to all the terms herein and Documents Related, please refrain from using or accessing our services in any manner.

All references to “you” or “your” in these Terms of Sale include the primary individual accessing or using the services, as well as all individuals on whose behalf a booking is made (e.g., travelers under the same booking). 

By requesting, accessing, or using our services through our website or agents, you confirm and agree that:

  1. You are of legal age of majority in your country or state of residence; and

  2. If you are requesting services on behalf of others, you have the legal authority to bind those individuals, including the assumption of all obligations on their behalf, and you are solely responsible for informing such persons about the applicable Terms of Sale and Documents Related.

Requesting a Trip 

By contacting us, you agree to allow us to communicate with you via email, phone, or other methods with your consent to organize a trip. You acknowledge that Jakuna acts as a travel agent only. We arrange various travel-related products on behalf of numerous transport and accommodation service providers, including, but not limited to, airlines, coach, rail, cruise line operators, and hotels. We do not own, operate, manage, or control these independent suppliers of services and we are not liable for their acts or omissions. Jakuna's obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. 

Requests cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider, not Jakuna. Conditions can change rapidly in a country at any time. 

Trip Confirmation & Payment Terms 

To confirm your trip, you must submit payment in accordance with the instructions provided by Jakuna. The proposal we send will clearly outline the total trip price, as well as all inclusions and exclusions.  We reserve the right to adjust the pricing of any unsold travel arrangements at any time and to correct any errors in previously confirmed bookings.

The following payment terms apply to all bookings:

  1. For trips starting more than 90 days from the booking date: A deposit of 30% of the total trip cost is required at the time of booking. The remaining balance must be paid no later than 90 days before the trip start date.

  2. For trips starting within 90 days of the booking date: Full payment is required at the time of booking.

All payments must be made in accordance with the instructions provided at the time of booking confirmation. By making a payment, the client agrees to the terms outlined herein. These payment terms may be amended on a case-by-case basis, and you will be informed prior to processing payment. Payment can be made via wire transfer, or credit card (subject to a processing surcharge). Failure to make full and timely payment may result in automatic cancellation of your booking, and you will be subject to cancellation charges as outlined in the “Changes & Cancellations By You” of this Terms of Sale. Once your deposit or full payment has been received and processed, you will receive a confirmation e-mail acknowledging receipt.

Planning Fee

Jakuna does not charge a planning fee. However, in certain cases -particularly when significant time and effort are invested in developing a customized itinerary or travel plan- a planning fee may be charged at Jakuna’s sole discretion.

If a planning fee is applicable, you will be notified in advance, and the amount will be clearly communicated before any charge is processed. This fee will be credited toward the total cost of your booking if the trip is confirmed. If the trip is not confirmed for any reason, the planning fee will be non-refundable and will serve as compensation for time and services already rendered.

By proceeding with a planning fee payment, you acknowledge and accept these terms.

Chargebacks

By booking travel services with Jakuna, you acknowledge and agree to abide by our Terms of Sale, including our cancellation and refund policies.

You agree not to initiate a chargeback or dispute with your credit card provider for any transaction made with Jakuna unless you have first made a good-faith effort to resolve the issue directly with us. In the event of a chargeback. We reserve the right to present this agreement and supporting documentation to the credit card company or financial institution as evidence of your acceptance of the charges and the terms under which the booking was made.

Unauthorized chargebacks or disputes that are determined to be unfounded may result in:

  • Suspension of future booking privileges.

  • Immediate cancellation of any pending reservations without a refund.

  • Recovery of the original payment amount plus any associated chargeback fees, legal fees, and collection costs.

Air travel Disclaimer

If your itinerary includes air travel, Jakuna will provide you with the name of the airline operating the flight(s) and the relevant flight details as made available to us at the time of booking. Please note that all flight schedules, equipment, routes, and terms are determined and controlled exclusively by the airline and are subject to change without notice, at the sole discretion of the carrier.

Your contract of carriage for any air travel component is directly with the airline, and all air transportation is governed by the airline’s own terms and conditions, including but not limited to those related to schedule changes, cancellations, name corrections, baggage policies, and boarding requirements.

It is your sole responsibility to:

  • Review and comply with the airline’s terms and conditions;

  • Ensure that your name on the ticket matches your travel documents exactly;

  • Complete check-in procedures within the time limits established by the airline;

  • Monitor your flight status for any changes or cancellations.

  • Jakuna acts solely as an intermediary and assumes no responsibility or liability for any acts, omissions, changes, or disruptions by the airline. We will not be held liable for any costs, damages, losses, or inconveniences arising from airline-related issues, including but not limited to delays, cancellations, missed connections, denied boarding, or changes to flight schedules.

Travel Insurance Disclaimer

We strongly recommend that you obtain comprehensive travel insurance to protect your travel investment and well-being. Such coverage should include, at a minimum, protection against trip cancellation or interruption, medical emergencies, illness or injury, lost, stolen, or damaged baggage, repatriation, emergency evacuation, and other unforeseen circumstances.

We also recommend that you consider policies offering "Cancel for Any Reason" (CFAR) coverage, which provides additional flexibility in the event of cancellation.

Please note that we are not an insurance provider, nor are we licensed or qualified to answer specific questions regarding the scope, suitability, or limitations of any insurance policy. You are solely responsible for selecting and obtaining insurance coverage that meets your needs.

If you choose to travel without adequate insurance coverage, you do so at your own risk. In such cases, Jakuna will not be held liable for any financial losses, expenses, or damages you may incur as a result of events that would have otherwise been covered by such insurance.

You expressly acknowledge that:

  • Purchasing appropriate travel insurance is your sole responsibility;

  • Our liability to you, if any, is limited to the extent of the insurance coverage you maintain. If you choose not to purchase adequate travel insurance, you understand and agree that you assume all risks, and Jakuna will not be responsible for any losses, expenses, or damages that would have been covered by such insurance.

  • This requirement forms an essential and non-negotiable part of our agreement.

Additional Services 

If you request any additional services or modifications to your itinerary before or during your trip—including, but not limited to, extra accommodations, excursions, transport, or upgrades— We will provide a written quote detailing the associated costs.

No such services will be booked or confirmed until:

  • You have expressly accepted the quote in writing (email suffices); and

  • Jakuna has received full payment or valid credit card authorization for the quoted amount.

All additional services are subject to availability and to the terms and conditions of both Jakuna and any involved third-party service providers. Once confirmed, such additional services shall be considered part of your booking and governed in full by these Terms of Sale.

Jakuna shall not be liable for any delays, denials, or changes resulting from your failure to timely accept or pay for such services.

Travel Documents and Entry Requirements 

You are solely responsible for ensuring that all required travel documents are valid and compliant, including passports, visas, health and vaccination certificates, and any other entry requirements for your destination(s). Passports must generally be valid for at least 6 months beyond your travel dates.

Jakuna may provide general guidance, but it is your responsibility to verify official requirements with relevant government agencies, including the U.S. Department of State and destination embassies or consulates. Any fines, costs, or travel disruptions due to incomplete or non-compliant documentation are your responsibility. 

It is also your responsibility to check the USA Government Travel advisories for your intended destination at travel.state.gov/content/travel.html.

For domestic U.S. travel, starting May 7, 2025, you must present a REAL ID-compliant driver’s license or identification card to board flights. For more information, visit www.tsa.gov/real-id.

We are not liable for denied boarding, entry, or any loss resulting from failure to meet documentation or regulatory requirements.

Age requirements

All travelers must be at least 18 years of age, unless accompanied by a parent, legal guardian or an appointed escort over the age of 18. who accepts full responsibility for the minor throughout the trip. The parent or legal guardian must provide written authorization for any appointed escort, and may be required to submit additional documentation as needed. Please note that certain activities or components of the itinerary may have their own age restrictions imposed by the third-party providers. These restrictions will be disclosed at the time of booking or when applicable. Jakuna is not responsible for any limitations or denials of participation based on age restrictions imposed by such providers. 

Traveler Substitution

If you request to substitute one traveler, we will attempt to accommodate the change but cannot guarantee it. You are responsible for any fees charged by third-party providers. This applies to any date or traveler modifications after booking confirmation and payment.

Changes & Cancellations By You

You may cancel your trip at any time by providing written notice. We will make reasonable efforts to accommodate changes; however, we cannot guarantee that modifications or refunds will be possible.

Cancellation charges will apply as outlined in your booking confirmation and are determined by the terms and conditions of the travel service providers (e.g., hotels, airlines, tour operators). These may include non-refundable deposits, full prepayments, or other penalties, depending on the provider.

No refunds will be issued for unused services or for passengers who do not travel.

In some cases, Jakuna may use special non-refundable or prepaid rates to secure better pricing or guarantee availability. These conditions will be clearly stated in your itinerary proposal or follow-up communications. By confirming your booking, you acknowledge and accept that such components are entirely non-refundable, regardless of when you cancel.

Additionally, certain destinations, services, or third-party suppliers may impose stricter cancellation policies that override our general terms. When applicable, these will be disclosed to you prior to booking and will govern in the event of a cancellation.

The following cancellation charges apply to all confirmed bookings:

  • More than 60 days before the trip start date: forfeiture of the deposit paid. (30% of the total trip cost). This amount is non-refundable under any circumstances.

  • Between 30-60 days before the trip start date: forfeiture of 50% of the total trip cost.

  • Less than 30 days prior to the trip start date: forfeiture of 100% of the total trip cost.

Changes & Cancellations By Jakuna Travel LLC


Jakuna reserves the right to cancel any booking, in whole or in part, at its sole discretion, including due to operational, safety, or supplier-related issues, or for any other reason deemed necessary. In the event that Jakuna cancels any portion of your confirmed travel arrangements, you will be notified in writing and, where feasible, offered an alternative of comparable value.

If no suitable alternative is available or accepted, Jakuna’s liability will be strictly limited to a refund of the amount actually paid by you for the canceled portion only. Under no circumstances shall Jakuna be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of enjoyment, missed connections, or non-refundable expenses incurred in preparation for the trip.

Force Majeure 

Hakuna shall not be liable for any cancellation or disruption caused by events beyond its reasonable control, including but not limited to natural disasters, weather conditions, terrorism, war, pandemics, civil unrest, governmental actions, acts of God, supplier insolvency, or transportation disruptions (“Force Majeure”). In such cases, refunds (if any) will be subject to the terms and conditions of the third-party providers and may be limited or unavailable.

You are strongly advised to obtain comprehensive travel insurance to cover unexpected cancellations, disruptions, and related expenses.

Assumption of Risks, Traveler Obligations, and Limitation of Liability

By booking travel services through Jakuna, you acknowledge that travel—whether domestic or international—may involve inherent and unpredictable risks, including but not limited to illness, injury, death, accidents, property loss, theft, delays, civil unrest, terrorism, natural disasters, and other events beyond the control of Jakuna.

You voluntarily assume all such risks, whether foreseen or unforeseen, and agree that Jakuna, its owners, officers, employees, agents, representatives, and affiliates shall not be held liable, to the fullest extent permitted by law, for any claims, losses, damages, liabilities, costs, or expenses arising from or in connection with your travel.

It is your sole responsibility to review and comply with all health, safety, visa, and entry requirements, and to consult relevant government resources such as the U.S. Department of State (travel.state.gov) and the Centers for Disease Control and Prevention (cdc.gov) prior to travel.

You further agree to conduct yourself responsibly, comply with all local laws and customs, and not engage in any behavior that could endanger yourself or others. You will be held solely liable for any consequences, including legal penalties, fines, or damages resulting from your conduct. Jakuna reserves the right to remove or refuse service to any traveler whose behavior is deemed unsafe, unlawful, or disruptive, without refund or compensation.

By proceeding with your booking, you expressly waive and release Jakuna from any and all legal claims, and this waiver shall be binding upon your heirs, successors, legal representatives, and assigns.

Severability

If any provision of these Terms of Sale is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect

Arbitration Notice

By agreeing to these Terms of Sale, you agree that all disputes arising out of or relating to these Terms of Sale or your trip shall be resolved through binding individual arbitration under the rules of the State of Florida, and governed by the laws of the United States of America. You waive your right to participate in a class action lawsuit or class-wide arbitration. 

Mediation and Arbitration Notice. Applicable Law.

If a dispute arises from or relates to this contract or the breach thereof, and if the dispute cannot be settled through direct discussions, the parties agree to endeavor first to settle the dispute by mediation administered by the American Arbitration Association under its Commercial Mediation Procedures before resorting to arbitration. The parties further agree that any unresolved controversy or claim arising out of or relating to this contract, or breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The mediation or the arbitration shall take place in the state of Florida, and the laws of Florida shall govern the arbitration proceedings.

All client claims must be submitted in writing and received by Jakuna no later than thirty (30) days after the completion of the booked travel itinerary. Claims not submitted and received within this timeframe will be deemed waived and barred.

Changes to Terms of Sale 

Jakuna reserves the right to modify, update, or replace these Terms of Sale at any time, in its sole discretion and without prior notice. Any material changes will be posted on our website and will indicate the date of the latest revision. It is your responsibility to review these Terms of Sale periodically for any updates.

Your continued use of our services, bookings, or website after such changes have been posted constitutes your full acceptance of the revised Terms of Sale, including any modifications made. If you do not agree to the amended terms, you must discontinue use of our services immediately.
